Counties CAN be formed by the Legislature. The opposition is once again incorrect.

We will be posting video from our recent victory in Senate Appropriations soon. Until then, we would like to point out that once we dispelled a lot of the misinformation surrounding the county, that the opposition’s concluding argument was that the law “already provides” a structure and that Sitgreaves County must be created by petition.

This simply isn’t true. The law states in A.R.S. 11-132:

Counties may be formed or divided either by legislative enactment, by statewide initiative pursuant to article IV, part 1, section 1, Constitution of Arizona, or by county initiative pursuant to this article. The requirements of this article, however, do not apply to counties formed or divided by legislative enactment or by statewide initiative.
